ADVICE TO SOLICITORS REGARDING DEFENCE INTERPRETERS
During any trial involving a deaf client as a defendant, the services of an independent interpreter should be reserved. Court appointed interpreters work for the court and are required to be impartial and to be seen as impartial. Therefore it is not good practice to ask court appointed interpreters to assist with instructions whilst a trial is in process. As a rule, court interpreters will decline requests to interpret between counsel and their client, requesting that the request be put before the judge/magistrate. The lack of a defence interpreter also hampers the defendant's ability to raise matters with counsel.
